Terms of Service
Last Revision: April 20, 2025
Welcome to
JobbersGigs.com (“
JobbersGigs”, “we”, “us”, or “our”). These Terms of Service (the “
Terms” or “
Agreement”) govern your access to and use of our website, applications, products, wallets/escrow features, and services (collectively, the “
Platform” or “
Services”).
By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and by all policies referenced here, including our
Privacy Policy,
Refund Policy, and
Acceptable Use Policy (AUP).
If you do not agree, do not use the Platform.
Important: These Terms include (i) limitations of liability, (ii) an agreement to resolve most disputes through binding arbitration, and (iii) to the extent permitted by law, a waiver of class or representative actions. Some jurisdictions provide consumers with non-waivable statutory rights; nothing here limits those rights.
If you register or use the Platform on behalf of a company or organization (“
Organization”), you represent that you have authority to bind that Organization. References to “you” include both you and the Organization.
0. Definitions & Interpretation
- Client: A user purchasing, commissioning, or posting work on the Platform.
- Gigger (freelancer/worker): A user offering and delivering services to Clients.
- Order: A transaction for services concluded through the Platform.
- Wallet: In-Platform balance associated with your account (e.g., Spendable, Pending, Earned).
- Escrow: Funds held by JobbersGigs or its providers pending release according to these Terms.
Headings are for convenience only and do not affect interpretation. “Including” means “including without limitation.”
1. Eligibility
To use the Platform, you must be at least 18 years old (or the age of majority in your jurisdiction), have legal capacity to contract, and not be subject to sanctions, embargoes, or legal restrictions that would prohibit your use. We may refuse, suspend, or terminate accounts at our discretion, including for risk, compliance, duplication, or abuse.
2. Account Registration & Security
You agree to provide accurate, current, and complete information and keep it updated. You must safeguard credentials, limit access to your account, and accept responsibility for all activity under it. We may request documents (KYC/KYB) at any time. We may pre-screen, remove, or refuse content; and access, preserve, or disclose account information to comply with law, enforce these Terms, respond to complaints, prevent fraud, or protect rights, property, and safety.
3. Roles, Relationship, and Use of the Platform
Users may act as Clients and/or Giggers. JobbersGigs is a marketplace; we are not a party to contracts between users and do not guarantee any party’s performance. Scope, milestones, revisions, acceptance, and deliverables are set by the parties.
You agree to use the Platform lawfully, provide true information, submit timely deliverables/proofs, and cooperate in good faith. We may publish ratings/feedback and moderate for policy compliance.
4. Payments, Wallets & Escrow
4.1 Funding & Wallets. Supported funding methods are shown at checkout/wallet pages. Funding may incur provider fees, FX spreads, and limits. Balances may be displayed in your selected currency; settlement occurs per our payment providers’ rails.
4.2 Escrow. Unless a category expressly states otherwise, Client payments for Orders are placed into Escrow. Upon Client acceptance (or deemed acceptance per Order timelines/policies), Escrow is released to the Gigger’s wallet (e.g., “Pending” → “Earned”), less applicable fees. If a dispute is opened, funds may remain on hold pending resolution.
4.3 Withdrawals. Giggers may withdraw available balances via supported methods and subject to verification, limits, and fees. Chargebacks or reversals may result in balance adjustments, offsets, or holds. We may require re-KYC before releasing funds.
4.4 No Off-Platform Payments. You agree not to circumvent fees or transact off-Platform for work initiated here. Doing so may result in suspension, termination, and/or fees/penalties.
5. Fees & Pricing
Fees are disclosed at point of use and/or in our
Fee Schedule. We may change fees at any time; the fee presented at transaction time applies to that transaction. Additional fees may apply to chargebacks, returned items, exceptional handling, or compliance reviews. Users are responsible for taxes unless we are legally required to collect/remit.
6. Orders, Revisions, Acceptance & Cancellations
Clients must review deliverables promptly and request revisions where available under the listing or category rules. If no action is taken within the stated review window, delivery may be deemed accepted and Escrow released. Cancellations and refunds follow the
Refund Policy.
7. Disputes Between Users
Clients and Giggers should first seek a good-faith resolution via in-Platform messaging and revision tools. If unresolved, either party may open a dispute within the Order. JobbersGigs may (but is not obligated to) mediate. We may request evidence and make a determination on Escrow release/return consistent with these Terms, applicable category rules, and fairness. Our determination is final within the Platform.
8. Freezing of Funds; Holds
We may place holds or freeze funds if we suspect fraud, chargebacks, violations of law/policy, sanctions risks, security concerns, or per lawful requests from authorities. We may request additional information (e.g., identity, invoices, proof of work). Funds may be released, returned, or forfeited in accordance with law and these Terms.
9. Acceptable Use Policy (AUP)
You must not:
- Post or solicit unlawful, defamatory, obscene, hateful, exploitative, or infringing content; or content involving minors or violence.
- Impersonate others; misrepresent skills, experience, or affiliation; submit fake/incomplete proofs.
- Manipulate ratings/feedback; demand bribes/free work; coordinate deception groups on/off Platform.
- Open multiple accounts; share/sell accounts; use VPN/proxies to evade limits or geo policies.
- Upload malware; attempt to hack; scrape at scale; disrupt the Platform or its infrastructure.
- Engage in prohibited tasks (e.g., fake reviews/testimonials, ad-click/fraud schemes, money shuffling).
- Violate IP rights; upload third-party content without authorization.
- Perform jobs targeting countries you are not located in when a listing is location-restricted.
Violations may result in content removal, warnings, holds, suspension/termination, forfeiture of funds where permitted, and legal action. See also Section 24 (Enforcement).
10. User Content; IP; Licenses
Your Content. You retain ownership of content you submit. You grant JobbersGigs a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and use such content to operate, improve, and promote the Platform. You warrant you have the necessary rights and that your content is lawful and non-infringing.
Platform IP. The Platform (software, design, trademarks, and content) is owned by JobbersGigs or licensors. Except as expressly permitted, you may not copy, modify, distribute, sell, or create derivative works. We may show ads near your content and use your public display name/icon in Platform features without compensation.
11. Third-Party Services & Links
The Platform may link to or integrate third-party services (payments, analytics, KYC). We are not responsible for third-party content, policies, or availability. Your use of third-party services is governed by their terms and privacy notices.
12. Privacy & Data Protection
Your use of the Platform is subject to our
Privacy Policy, which explains how we collect, use, share, and protect personal data and your rights. You must keep account data accurate and comply with verification requirements. Deleting your data may disable your account if essential Platform functions cannot be provided.
13. Errors, Complaints & Unauthorized Activity
Notify us immediately via
/contact if you suspect unauthorized access, a payment error, or an incorrect transaction. We may place temporary holds while we investigate. If we request written details, failure to respond within 10 business days may prevent credits/adjustments. We will provide investigation outcomes and, where applicable, supporting information.
14. Refund Policy
Nature of Funds. Wallet balances are for Platform use. Where refunds are permitted, we typically return to the original funding method if feasible. Some rails (e.g., certain crypto) may be non-refundable by their nature.
When Refunds May Apply.
- Non-delivery or verified failed performance where the Gigger is at fault.
- Verified fraud or duplicate/unauthorized transaction.
- Platform error resulting in incorrect charge.
When Refunds May Not Apply.
- Work substantially performed and accepted (or deemed accepted) by the Client.
- Violations of policy or law; sanctions/AML restrictions; chargeback abuse.
- Inability to refund to certain payment rails; legal restrictions.
Process. Open an Order dispute first. If unresolved, escalate via
/contact with evidence. We aim to acknowledge within 48 hours and resolve or provide next steps as promptly as possible. We may require identity verification before issuing a refund.
15. Fee Schedule
Fee Type | Amount / Range | Notes |
Client Service Fee | 5–10% of order value | Shown at checkout prior to payment |
Gigger Service Fee | 10% of order value | Deducted on release from Escrow |
Wallet Funding Fee | Varies by method | Provider/FX fees may apply |
Withdrawal Fee | Varies by method | Shown before confirming withdrawal |
Chargeback/Return Handling | Actual costs + admin | May include provider fees |
Exceptional Handling / Compliance | Case-by-case | Only if directly incurred by your activity |
Fees and thresholds may change; see checkout/wallet pages for current amounts.
16. Suspension, Termination & Effects
We may suspend or terminate access immediately for violations, legal requests, risk, non-payment, or technical/security issues. You may close your account anytime. Termination does not affect accrued obligations (fees, disputes, holds). On termination, we may retain, release, or return funds consistent with law, provider requirements, and these Terms.
17. Warranties; Disclaimers
The Platform is provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including merchantability, fitness for particular purpose, non-infringement, and uninterrupted or error-free operation. Outcomes depend on user conduct and third-party services; we do not guarantee results.
18. Limitation of Liability
To the maximum extent permitted by law, JobbersGigs and its affiliates, officers, directors, employees, and providers shall not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages; loss of profits, revenue, data, or goodwill; or damages arising from user conduct or third-party services. Our total liability for all claims in any 12-month period shall not exceed the greater of (i) fees you paid to JobbersGigs in that period or (ii) USD 100. Nothing excludes liability that cannot be excluded by law (e.g., fraud).
19. Indemnification
You will defend, indemnify, and hold harmless JobbersGigs and its affiliates, officers, directors, employees, and agents from any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your content or conduct; (b) your use of the Platform; (c) your breach of these Terms or law; or (d) disputes between you and another user. We may assume exclusive defense and control of any matter; your indemnity still applies.
20. DMCA / Notice-and-Takedown
We respond to copyright notices that meet applicable legal standards (including U.S. DMCA). To submit a notice, provide:
- Your physical/electronic signature and authority.
- Identification of the copyrighted work(s).
- Identification of the allegedly infringing material and its Platform location (URL).
- Your contact details.

21. Complaint Policy & Escalation
Stage One: Open a support ticket at
/contact. We aim to acknowledge within 48 hours, investigate, and propose a resolution or next steps within a reasonable timeframe.
Stage Two: If unresolved, request escalation. Senior staff or compliance may review evidence, speak with involved staff/users, and issue a decision. We will inform you in writing of outcomes and any actions taken.
Final Stage: If still unsatisfied, you may pursue the arbitration process under Section 23 (after good-faith resolution efforts).
Anonymous complaints are reviewed to the extent possible but may limit our ability to investigate.
22. Assignment; Service Providers
You may not assign or transfer these Terms without our prior written consent. We may assign these Terms and engage service providers to perform services under our control (payments, hosting, analytics, KYC, etc.).
23. Dispute Resolution, Governing Law & No Class Actions
Good-Faith Resolution. You agree to first attempt to resolve disputes by contacting us via
/contact and allowing a reasonable time.
Arbitration (UK-style). If not resolved, any dispute arising out of or in connection with these Terms or the Platform shall be finally resolved by binding arbitration under the
Arbitration Act 1996, administered by a recognized UK arbitral institution (e.g., LCIA/CIArb rules), by a sole arbitrator, in London, England, in English. The award shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.
No Class Actions. To the extent permitted by law, disputes must be brought in an individual capacity, not as a class/representative action, and the arbitrator cannot consolidate claims without all parties’ consent.
Governing Law. These Terms are governed by the laws of
England and Wales. Subject to the arbitration clause, the courts of England and Wales have exclusive jurisdiction. Consumers may have mandatory local rights that prevail over this clause.
24. Enforcement; Breach
We may remove content, suspend/terminate accounts, freeze funds, reverse transactions, notify authorities, and recover damages/costs where permitted by law. We may charge an administrative fee commensurate with the costs incurred due to illicit activity or policy breaches.
25. Export Controls & Sanctions
You agree to comply with applicable export, re-export, and sanctions laws (including U.K., E.U., and U.S. programs). You represent and warrant that you are not on any sanctions list, will not use the Platform for prohibited end uses, and will not export restricted content or technology in violation of law.
26. Amendments
We may revise these Terms by posting an updated version. For material changes, we will provide notice on the Platform and/or by email where appropriate. Your continued use after the effective date constitutes acceptance of the updated Terms.
27. Severability; Waiver; Entire Agreement
If any provision is unlawful or unenforceable, it will be modified to the minimum extent necessary, and the remainder remains in effect. No waiver of any term is a continuing waiver. These Terms (including linked policies) are the entire agreement between you and JobbersGigs and supersede prior understandings related to the Platform.
28. U.S. State Insurance-Style Fraud Warnings (For U.S. Users)
Where applicable, and to mirror disclosures often required in certain U.S. contexts, the following warnings apply to U.S. users. These do not expand Platform coverage and are provided for transparency and parity with other providers’ disclosures:
- Alabama: Any person who knowingly presents a false or fraudulent claim for payment of a loss or benefit or knowingly presents false information in an application is guilty of a crime and may be subject to restitution, fines, or imprisonment.

Note: These warnings are jurisdiction-specific and apply only insofar as your use touches relevant regulated activities. They do not imply that JobbersGigs offers insurance or similar financial products.
